VESSEL LEASE AGREEMENT

Article 1: By this agreement, I accept the lease of a vessel with an outboard motor and, at this moment, become the lessee, while on the other side of the agreement, the lessor is Nebulus (hereinaher: the lessor). By doing so, I become a party to this agreement and undertake to pay the amount specified in the Vessel Delivery and Acceptance Record for the subject vessel.

Article 2: I, at this moment, declare responsibly that I have a valid vessel operator’s license and will personally operate the vessel, not allowing others to do so. I also declare that I am familiar with all the rules and laws of navigation in the territorial waters of the Republic of Croatia and will not violate or breack them in any way. I agree that the lessor retains a copy of my personal identification document and a valid vessel operator’s license for the duration of this agreement.

Article 3: I agree to provide the lessor with a deposit in the amount specified in the Vessel Delivery and Acceptance Record if damage occurs during the vessel’s lease period, which will be compensated from the given deposit. Upon returning the vessel to the lessor, the lessor personally inspects the subject vessel in the presence of the lessee. The deposit is refunded to the lessee if the vessel is returned in good conditon and without damage. If the vessel or its part or equipment is damaged during the term of the agreement, all costs incurred in connection with this shall be borne by the lessee and charged from the deposit. Suppose the damage results from ignorance or unprofessional and irresponsible handling of the rented vessel and accompanying equipment. If the damage is greater than the deposit amount, and the insurance refuses to cover the damage due to the manner of handling, in that case, the lessee is obliged to compensate for the full amount of the damage.

Artile 4: If during the lease period, due to ignorance or unprofessional and irresponsible handling of the rented vessel and accompanying equipment, such damage occurs that the vessel is out of function or damage that would prevent the lessor from continuing the vessel rental activity, I agree to compensate for the lost profit in an amount equal to the rental amount for the number of days the subject vessel is out of function.

Article 5: By this agreement, I confirm that I am taking the vessel at my responsibility and am personally responsible for all acRviRes undertaken by myself or any passengers on the vessel during the agreement term.

Article 6: The duration of this agreement is considered from the moment of taking over the vessel (09:00 AM) until the moment of returning the ship (7:00 PM). In the case of a multi-day lease, the duration of this agreement is calculated from the first day of taking over the vessel (09:00 AM) to the last day of the lease, returning the vesel (7:00 PM). As the vessel is not intended for overnight stays, I declare that the vessel will not be used for such purposes in the case of a multi-day lease. For each hour of delay in returning the subject vessel, I agree to pay an amount equal to 50% of the daily rental of the vessel.Article 7: I agree to the general terms and conditions of the lessor, which are amached to this agreement, and which I have personally read.

GENERAL BUSINESS CONDITIONS – VESSEL LEASE

Article 1: These General business conditions (hereinaher: General conditions) determine the rights and duties between the Obrt Nebulus, as the leaser (hereinaher: leaser) and the user of the vessel lease (hereinaher: lessee) which occur at the moment of entering into the Vessel Lease Agreement (hereinaher: Agreement). The General Conditions are a part of the Agreement, which legally binds both parRes, the lesser and the lessee, and both undertake to fulfill their Agreement duties in faith.

Article 2: Before entering the Agreement, the lessee must show the leaser a valid identification document and a valid vessel operator’s license. Furthermore, the leaser may make a copy of the given identification document and keep it until the Agreement intenterely performed.

Article 3: The vessel from the Agreement may be operated by the lessee only, or in case the lease includes a skipper, only the skipper may manage it. The lessee is liable for all consequences if an unauthorized person uses the vessel.

Article 4: If the lessee wants to book the vessel in advance, they must give the leaser their and the passengers’ data at the time of reservation. Personal data mean the name, surname, address, date of birth, type, and number of a valid identification document. In additin, if the lessee operates the vessel personally, data on the vessel operator’s license must be given. The reservation will be considered binding after the deposit of 50% of the total lease amount stated in the Agreement is paid. The valid price is the price indicated in the Agreement, which was valid when paying the deposit or reservatioon of the vessel. The lessee must pay the remaining price when taking the vessel over.

Article 5: If the lessee withdraws the lease aher the vessel has been booked and the deposit paid, they have to notify the leaser about this decision without delay, in written form. The leaser will determine the refund amount to be returned to the lessee according to the date when the wrimen withdrawal from the Agreement is received:

• For a retreat made more than 30 days before the commencement of the lease, the paid deposit will be returned in full

• For a withdrawal made 30 days or less before the commencement of the lease, the paid deposit will not be returned, which means that the leaser keeps the whole paid amount.

Article 6: In line with the signed Agreement, the vessel lease price has to be paid by the lessee in full before the vessel takeover is effectuated. The price does not include expenses in marinas, berth taxes, residence taxes, and fill-up of the gas and water tanks before the return of the subject vessel

Article 7: When taking the vessel over, the lessee has to leave a deposit to the leaser right before taking over the vessel where the takeover is effectuated. The mandatory deposit compensates for all possible material damages of the subject vessel in the duraRon period and line with the Agreement.

Article 8: The lessee inspects the vessel of the Agreement personally before the takeover of the vessel and has to inform the leaser about material flaws immediately aher the inspecRon and before taking over the vessel.

Subsequent complaints will not be considered. However, such subsequently reported damages will be considered as occurring during the duraRon period of the Agreement, and the lessee will be charged for them.

Aricle 9: The subject vessel has to be taken over at 10 a.m. and returned at 6 p.m. Such a period is considered a one-day lease of the vessel. In the case of several days lease, the vessel must be taken over on the first day at 10 a.m. and returned on the last day of the lease by 6 p.m. The vessel is moored where it was picked up from 18:00 to 10:00. This is facilitated for control purposes and coordination of other arranged tours with the skipper. The Agreement regulates the penalizaRon for a late return of the leased vessel. The subject boat is not meant for overnight stays, so it must not be used for such purposes.

Article 10: The lessee undertakes to return the vessel in the same condiRon as at the takeover. The lessee must keep the vessel clean and neat during the lease periods. If the vessel is returned in an unorderly condiRon, the lessee may be charged for cleaning the vessel.

Article 11: If the Agreement’s duRes and the General business conditions have been infringed, the Agreement will be terminated. At the same Rme, the lessee has to compensate for the occurred damage as determined by the leaser. The leaser protects the lessee’s data by collecRng only the necessary and essenRal data in line with the Agreement. Possible disputes arising from the Agreement will be solved before the competent court in Pula.

• La linea Mareth, lungo la quale si combattè nella primavera del 1943
• La medina di Sfax, la medina forse più interessante di tutte le città tunisine, in quanto ancòra ricca di artigiani, meno turistica di quella di Tunisi e più grande di quella di Hammamet o Sousse….
• Grande Moschea di Kairouan. Non è visitabile all’interno se non si è musulmani, ma la visita “dall’esterno” merita comunque, specialmente se un pernottamento a Kairouan fa parte del programma.
• El Jem, che non necessita di presentazioni, anfiteatro romano ottimamente conservato, un must.

In Tunisia l’attivismo jihadista inizia a comparire a partire dagli anni Ottanta come reazione ad un governo laico che vieta e reprime qualsiasi forma di discorso islamico in generale. In questi anni, la breve vita del gruppo Jihad Islamica, rapidamente smantellata dal Presidente Habib Bourguiba, riflette l’aspetto disorganizzato e fragile del primo tentativo di strutturare una milizia jihadista in Tunisia.

Curiosamente, oggi il paese è diventato il primo fornitore di giovani combattenti nei diversi conflitti in corso in Iraq, Libia, Mali e Siria. Inoltre l’instabile situazione politica e di sicurezza tunisina ha attirato i veterani del jihad internazionale per fondare, per la prima volta nella storia del paese, Ansâr al-Sharî‘a in Tunisia (AST), un’organizzazione avente come ruolo principale quello di guadagnarsi il supporto popolare utile per intraprendere il jihad in Tunisia e al contempo fornire supporto logistico e strategico alle diverse brigate nascoste sia tra le montagne che tra le cellule dormienti delle aree urbane del paese stesso.

Per comprendere le dinamiche che si celano dietro l’evoluzione del jihad tunisino è impossibile prescindere dagli aspetti dottrinali e teorici che circondano il fenomeno. Il jihadismo è connesso ad una completta rete di termini derivanti dalla giurisprudenza (fiqh) islamica e a vari movimenti di pensiero coi quali condivide lo stesso sfondo ideologico. In particolare ci si riferisce al fenomeno salafita, che è un movimento vario e complesso e difficile da catalogare. Possiamo azzarsdare la schematizzazione seguente. In Tunisia pare vi siano queste tre componenti:

• La salafiyya ‘almiyya, il salafismo ‘purista’, ‘scientifico’ o ‘scritturalista’: è

rappresentato da uomini di mezza età che vivono vite tranquille dedicandosi alla tarbiyya, all’istruzione, insistono sull’implemento della sharia e rifiutano la democrazia tenendosi ai margini della vita politica

• Il salafismo “politico” lo rappresentano, invece, i partiti di nuova fondazione i quali ritengono che la partecipazione al sistema democratico imperfetto possa servire da “veicolo per raggiungere una sorta di califfato” o un

sistema politico maggiormente orientato verso l’implemento delle leggi della sharia

• Il salafismo jihadista, infine, si caratterizza per la strenua opposizione partitica e per la legittimazione dell’uso della violenza. I jihadisti invocano la rivoluzione per applicare la loro singolare e rigida interpretazione della legge sacra.
